Top court in Germany lowers barriers for customers to sue over rule-breaking software. It was decided that the only way carmakers can escape litigation was to prove that there was no way to know that the software used was illegal. Usually the onus is on the customers to prove that the carmaker acted intentionally which is hard to prove. This change makes it the carmakers responsibility to prove otherwise.
The ruling was based on the idea that customers would not pay the full price if they knew that a specific device was use to defeat emissions monitors. The scandal first came to light in 2015 but the companies still face repercussions to this day.
